Cancellation Terms and Conditions for Bed & Breakfast Ravelin
1. Applicability
These cancellation terms and conditions apply to all reservations made at Bed & Breakfast Ravelin, unless otherwise expressly agreed in writing at the time of booking.
The cancellation terms and conditions form an integral part of the agreement between Bed & Breakfast Ravelin and the guest.
2. Cancellation by the Guest
The guest may cancel the reservation free of charge up to seven days before the agreed arrival date.
If cancelled less than seven days before the agreed arrival date, 100% of the total agreed reservation price is due.
The day of arrival is not included when calculating the cancellation period. The determining factor is the moment Bed & Breakfast Ravelin receives the cancellation.
After cancellation, the entire reservation is forfeited. Rooms will not be held without a new, confirmed booking.
3. Method of Cancellation
Cancellations must be communicated in writing via email, WhatsApp, or the booking platform on which the reservation was made.
The cancellation takes effect from the moment Bed & Breakfast Ravelin receives it.
Bed & Breakfast Ravelin will confirm receipt of the cancellation whenever reasonably possible.
4. No-Show
If the guest does not arrive without prior cancellation, 100% of the total agreed reservation price is due.
This is considered a no-show.
5. Early Departure
If the guest decides to cut their stay short after arrival, there is no right to a refund for unused nights or already reserved additional services.
6.1 Cancellation, No-Show, and Substitute Guests
A reservation can be cancelled free of charge up to seven days before the agreed arrival date.
If cancelled within seven days of the arrival date, 90% of the agreed accommodation price is due. Unused and yet-to-be-delivered additional services, such as breakfast, dinner, or BBQ, will not be charged unless there are demonstrable specific costs already incurred that cannot be cancelled.
Bed & Breakfast Ravelin is not obligated during this cancellation period to actively seek a replacement guest, re-list the accommodation, place paid advertisements, reduce the price, or offer the accommodation for a shorter stay or under less favorable conditions.
Until the agreed check-in time, the guest may always propose a substitute guest. The substitute guest must take over the entire reservation for the same accommodation and stay period. The takeover only takes effect once Bed & Breakfast Ravelin has confirmed it in writing and all due amounts have been paid.
A one-time change and administration fee of €10 per reservation is charged for checking, modifying, and reconfirming the reservation.
If the guest does not arrive before the end of the standard check-in time (3:00 PM) on the arrival date, it is considered a no-show. From that moment, Bed & Breakfast Ravelin is not obligated to accept a substitute guest, contact the original guest, or take any other measures and will charge the full amount for the accommodation and additional purchased services and products.
Therefore, in case of a No-SHOW, there is no refund or the full payment must be made.
If the same accommodation for the same stay period is re-rented entirely or partially, only the actual net revenue from that substitute rental will be deducted from the due cancellation amount. Costs directly related to the substitute rental may first be deducted.
The guest remains entitled to demonstrate with concrete and verifiable facts that Bed & Breakfast Ravelin has not suffered any loss or that the actual loss is significantly lower than the calculated cancellation amount. The mere assumption that the accommodation might have been re-rented is not sufficient. The burden of proof lies with the guest/renter.
6.2 Reimbursement by Cancellation Insurance
Any travel or cancellation insurance held by the guest is separate from the payment obligation to Bed & Breakfast Ravelin. The guest remains responsible for the cancellation fees due under these terms.
After fully paying the cancellation fees, Bed & Breakfast Ravelin will provide a cancellation invoice or written statement upon request that the guest can submit to their insurer. Bed & Breakfast Ravelin does not guarantee that the insurer will actually reimburse the cancellation fees.
Reimbursement by an insurer or other third party does not entitle the guest to double compensation. If, after reimbursement by an insurer, the guest becomes entitled to a full or partial refund, for example, due to re-renting the same accommodation for the same stay period, the guest must fully and truthfully inform Bed & Breakfast Ravelin.
Before processing a refund, Bed & Breakfast Ravelin may require the guest to provide written confirmation of:
whether the cancellation fees have been fully or partially reimbursed by an insurer or other third party;
the amount reimbursed;
whether any reimbursement claim against the insurer has been assigned.
Bed & Breakfast Ravelin may request appropriate proof of payment or reimbursement. If a reimbursement claim has been assigned to the insurer by paying the damage, the relevant amount will not be paid again to the guest but settled with the insurer.
The guest is responsible for timely notification of any subsequent refund, price reduction, or other compensation to their insurer.
This provision does not limit the guest's statutory right to demonstrate with concrete and verifiable data that Bed & Breakfast Ravelin has not suffered any loss or that the actual loss is significantly lower than the calculated cancellation amount.
This prevents double payment while not excluding the legal possibility of demonstrating lower damage. When an insurance company pays for a claim, the right to reimbursement for the reimbursed portion may be assigned to the insurer. A fixed cancellation fee in general terms must allow the guest to demonstrate that no or significantly less damage has occurred.
7. Additional Services
Pre-reserved additional services, including breakfast, dinner, and BBQ, can be cancelled free of charge up to seven days before the agreed arrival date.
If cancelled less than seven days before arrival, these services may be charged in full or in part if purchases have already been made, preparations have been started, or other costs have arisen.
Unused minibar products and unconsumed charging costs will not be charged.
8. Amendment or Rebooking
A request to change the arrival or departure date does not automatically constitute a free cancellation.
Rebooking is only possible based on availability and with written confirmation from Bed & Breakfast Ravelin.
Any price differences will be passed on to the guest.
If rebooking is not possible and the guest does not wish to keep the original reservation, the regular cancellation terms and conditions apply.
9. Bookings Made via Booking Platforms
For reservations made through an external booking platform, such as Booking.com, the cancellation terms and conditions agreed upon for that specific reservation on the platform apply.
Cancellations or changes should generally be requested through the relevant booking platform.
If the platform's terms and conditions differ from these cancellation terms, the terms of the specific reservation on the booking platform take precedence.
10. No Statutory Right of Withdrawal
For agreements concerning the provision of accommodation for purposes other than permanent residence, where a specific date or period has been agreed upon for the performance of the service, there is no statutory right of withdrawal of fourteen days in accordance with § 312g para. 2 no. 9 of the German Civil Code (BGB).
The guest can only terminate the reservation in accordance with the cancellation terms and conditions agreed upon at the time of booking.
11. Cancellation by Bed & Breakfast Ravelin
Bed & Breakfast Ravelin may cancel a reservation if performance of the agreement is impossible or unreasonably unacceptable due to:
Force majeure.
Fire, flood, or serious technical breakdowns.
Government measures.
Serious safety or health risks.
The guest providing incorrect or incomplete information.
Failure to make a agreed payment on time.
A serious or anticipated breach of the General Terms and Conditions or House Rules.
If the cancellation is not attributable to the guest, any amounts already paid for non-delivered services will be refunded.
If the cancellation can be attributed to the guest, the agreed payment and cancellation terms and conditions remain in effect.
Further statutory rights and claims remain unaffected.
12. Force Majeure on the Guest's Side
Personal circumstances of the guest, including illness, accident, transportation problems, flight cancellation, weather conditions, or other unforeseen events, do not automatically entitle the guest to free cancellation.
The guest is advised to take out appropriate travel or cancellation insurance.
In special circumstances, Bed & Breakfast Ravelin may offer an alternative solution out of goodwill. This does not create rights for other or future reservations.
13. Refund
If the guest is entitled to a refund, the relevant amount will be refunded as soon as possible via the original payment method, insofar as technically feasible.
Any demonstrable transaction costs that Bed & Breakfast Ravelin does not receive back from the payment service provider may, to the extent permitted by law, be deducted from the amount to be refunded.
14. Governing Law and Final Provisions
These cancellation terms and conditions are governed by the laws of the Federal Republic of Germany.
Compulsory legal provisions for the protection of consumers remain in effect.
If a provision of these cancellation terms and conditions is wholly or partially not part of the agreement or proves to be invalid, the remaining provisions will remain in force. In place of the invalid provision, the applicable statutory provisions shall apply in accordance with § 306 BGB.
